Therapist Independent Contractor Agreement

1. Relationship of Parties
This agreement establishes an independent contractor relationship between CasaBliss Massage ("CasaBliss") and the licensed massage therapist ("Therapist"). Nothing in this agreement shall be construed to create an employer-employee relationship, partnership, joint venture, or agency relationship.
2. Services
Therapist agrees to provide professional therapeutic massage services to clients referred by CasaBliss. Therapist retains full autonomy over session techniques and methods within the agreed service protocols.
3. Licensing & Insurance
Therapist represents and warrants that they:
- Hold a valid Florida massage therapy license in good standing
- Maintain current liability insurance (minimum $1M per occurrence)
- Will immediately notify CasaBliss of any license suspension, revocation, or lapse in coverage
4. Professional Conduct
Therapist agrees to:
- Arrive on time (within 10 minutes of scheduled start)
- Maintain professional appearance and hygiene standards
- Treat all clients with respect and dignity
- Adhere to ethical standards set by AMTA and ABMP
- Never engage in or tolerate inappropriate behavior of any kind
- Carry and use required supplies and equipment
5. Session Acceptance & Cancellations
Therapist is expected to accept at least 80% of offered sessions. Declining a session after acceptance (less than 2 hours before start) counts against your reliability score and may affect future assignment priority.
Cancellations must be reported immediately via the therapist portal. Repeated last-minute cancellations may result in account suspension.
6. Compensation
Compensation per session is as agreed at onboarding. Payouts are processed weekly (every Thursday) for sessions completed and settled in the prior week. CasaBliss reserves the right to hold payment for sessions under dispute or investigation.
7. Non-Solicitation
Therapist agrees not to solicit or directly book clients introduced through CasaBliss outside of the CasaBliss platform for a period of 12 months following the end of this agreement. This restriction applies only to clients with whom Therapist had no prior relationship before joining CasaBliss.
8. Confidentiality
Therapist agrees to maintain strict confidentiality of all client personal, health, and contact information. This obligation survives termination of this agreement. Unauthorized sharing of client data may result in immediate termination and legal action.
9. Safety & Reporting
Therapist agrees to report any unsafe session environments, client misconduct, or incidents immediately through the therapist portal or via WhatsApp to CasaBliss management. CasaBliss will respond to all safety reports within 2 hours during business hours.
10. Termination
Either party may terminate this agreement with 7 days written notice. CasaBliss may terminate immediately for cause including: license lapse, gross misconduct, client harm, repeated no-shows, or policy violations.
11. Independent Contractor Obligations
As an independent contractor, Therapist is solely responsible for:
- Payment of all self-employment taxes (federal, state, local)
- Maintaining their own business expenses and equipment
- Filing their own tax returns (CasaBliss issues 1099-NEC for earnings ≥$600/year)
12. Governing Law
This agreement is governed by the laws of the State of Florida. Disputes shall be resolved in Miami-Dade County courts.
